Contest Rules
KIX 102 FM / WKIX-FM General Contest Rules

FM 102.9, LLC (the “Company”) may, from time to time, conduct various contests and sweepstakes in connection with radio station KIX 102 FM / WKIX-FM (each, a “Contest”). By entering any Contest, entrants agree to be bound by these General Contest Rules and any applicable Specific Rules.
Specific details for each Contest (the “Specific Rules”), including entry procedures, additional eligibility restrictions, prize details, contest deadlines, and winner selection, may vary and will be disclosed on air or on the station’s website.
In the event of any conflict between these General Contest Rules and the Specific Rules, the Specific Rules shall control. Collectively, these are referred to as the Contest Rules.
1. General

No Purchase Necessary: Making a purchase will not increase your chances of winning.

Void Where Prohibited: The Contest is governed by all applicable federal, state, and local laws.

By entering, entrants agree to comply with all applicable law and Contest Rules, and to abide by all decisions of the Company.
2. Eligibility

Open only to legal U.S. residents residing in North Carolina who are 18 or older at the time of entry.

Limit one winner per household and one winner per immediate family.

Employees and contractors of the Contest Parties and their immediate families are not eligible.

Immediate family includes spouses, grandparents, parents, siblings, children, grandchildren, in-laws, and anyone residing in the same household.

Contest Parties include the Company, sponsors, co-sponsors, prize providers, and their respective owners, parent entities, subsidiaries, and affiliates.

Groups, clubs, or organizations may not participate.
-
Proof of age, identity, and eligibility may be requested. All information must be complete and accurate.

Individuals who have won a Contest in the past 30 days are not eligible.

The Company reserves the right to disqualify entrants who fail to follow Contest Rules.
3. How to Enter

Entry procedures and deadlines are governed by the Specific Rules.

All deadlines refer to Eastern Time.

Entries must be received during the specified Contest entry period.

Entries become property of the Company and will not be returned.

The Company is not responsible for entries that are lost, late, misdirected, incomplete, illegible, damaged, undeliverable, or delayed.

Automated, photocopied, or mechanically generated entries are void.
-
Online entries require a valid e-mail or social media account; entries are attributed to the authorized account holder.

Call-in entrants using online streams may experience delays and be at a disadvantage.
Entry Materials:
By submitting materials, entrants agree that:

They own or control all rights in the submitted materials.

Materials do not violate any trademark, copyright, privacy, publicity, or other rights.

Entrants grant the Contest Parties a perpetual, worldwide, royalty-free license to use, copy, display, reproduce, modify, publish, and distribute the materials in any media.

Materials may not contain personally identifiable information for anyone under 18.
-
Materials may not contain offensive, illegal, or inappropriate content.
Note: Dates and times are subject to change due to technical issues, emergencies, or Company discretion.
4. How to Win

Winner selection is governed by the Specific Rules.

Winners may be randomly selected or chosen based on skill, judgment, or other criteria at the Company’s discretion.

Winners will be notified via phone, email, or mail using the contact information provided.

Winners must respond within 30 days (or shorter if specified) or forfeit the prize.
-
Winners and guests may be required to sign forms including government-issued ID, tax forms, or intellectual property release forms. Failure to do so may result in disqualification.
5. Publicity Release

By entering, entrants grant the Contest Parties irrevocable consent to use their name, city, likeness, photos, voice, comments, ideas, and statements for publicity, promotion, or advertising without additional compensation.
6. Prizes

If errors occur or a tie happens, a random drawing will determine winners.

Only the advertised number of prizes will be awarded.

All expenses not included in prize descriptions (taxes, travel, parking, gratuities, etc.) are the responsibility of the winner.

Prizes are non-transferable; no cash substitution allowed.
-
Company may substitute prizes of equal or greater value.
-
Company is not responsible for lost, delayed, or damaged prizes after delivery.
7. Odds of Winning

Randomly selected contests: odds depend on the number of eligible entries.

Skill-based contests: no “odds of winning” are specified.
8. Terms and Conditions / Limitation of Liability

Attempts to tamper with Contest administration may result in disqualification and legal action.

Company may disqualify entries in case of anomalies or irregularities.
-
Winners and entrants agree to release, indemnify, and hold harmless the Contest Parties from all liabilities, claims, or damages arising from participation.

Company is not responsible for errors, printing mistakes, or technical malfunctions.

Decisions by the Company are final.

Prizes valued at $600 or more require social security numbers for tax purposes.
9. Force Majeure / Internet Disclaimer

If the Contest cannot run as planned due to events beyond Company control (virus, tampering, technical failures, acts of God, etc.), Company may cancel, suspend, or modify the Contest.

Company assumes no responsibility for errors, delays, or damages caused by technical failures or participation.
-
Company disclaims warranties regarding any prize, including implied warranties of merchantability or fitness.
10. Arbitration / Choice of Law

Except where prohibited, disputes shall be resolved via arbitration under the American Arbitration Association rules.

Claims are limited to out-of-pocket costs; no attorneys’ fees or punitive damages.

Laws of North Carolina govern. Arbitration venue: Wake County, NC.
-
If arbitration is prohibited, courts of Wake County, NC, will have exclusive jurisdiction.
-
Invalid provisions do not affect remaining Contest Rules.
11. List of Winners

To request winners’ names, mail a self-addressed stamped envelope within 60 days of the Contest to:

12. Contest Sponsor

FM 102.9, LLC / KIX 102 FM / WKIX-FM is the sole sponsor unless otherwise stated.

Contests using social media platforms are not sponsored or endorsed by those platforms.
